NOW COMES FRANCIS CASE by his attorney Melanie Alexandrine Madsen and

respectfully requests a Review pursuant to 415 ILCS 5/31

.1 (2005), of the Administrative citation

issued to Francis Case in June of 2006 and in support of this motion he states as follows:

1 .

He Does not own or operate a dumping facility in any county .

2.

The facility known as Case, Francis, is not owned, occupied or operated by him

.

3 .

He has not occupied or owned such a facility at any time .

4 .

He has no knowledge of an inspection of the facility by the Ogle County Solid

Waste Management Department but maintains that he is not responsible for

causing or allowing open dumping at the facility described in the citation

.

5.

He accepts responsibility

for open burning of tires but maintains he did not

operating a dumping facility

.
