Standards
On June 30, 2006, the Illinois EPA received from Marathon Pipe Line LLC ("Marathon") a
request for provisional variance to allow the loading of gasoline onto barges at its Wood River
barge dock without the requisite vapor collection and control system for volatile organic material
("VOM") emissions .
The Illinois EPA accepted this request for review pursuant to the
requirements of the Illinois Environmental Protection Act
("Act") and the applicable Agency
regulations .

The Illinois EPA evaluated the request pursuant to the requirements of Sections 35, 36, and 37 of
the Act and the Agency regulations at 35 Ill. Adm. Code Part 180 . The Illinois EPA is granting
Marathon's request for provisional variance as the source has demonstrated that an arbitrary and
unreasonable hardship will result in the event of a denial . More specifically, the regulatory relief
requested by Marathon is intended to facilitate loading of gasoline for delivery to terminals along
the Ohio River where short-term gasoline supply has been disrupted by an unanticipated
disruption in fuel production at Marathon Petroleum Company's Catlettsburg, Kentucky refinery .
Marathon seeks provisional variance from permit conditions 3 and 8 as pertain only to gasoline
and gasoline blend loadout contained within Federally Enforceable State Operating Permit
("FESOP") number 73021451 and 35 Ill. Adm. Code Part 219 Subpart GG (Marine Terminals)
.
The Illinois EPA is granting relief from condition 8, as pertains to gasoline and gasoline loadout
the applicable requirements of 35 Ill. Adm. Code Section 219.762 (control requirements),
Section 219.768 (testing and monitoring), and Section 219.770 (recordkeeping and reporting)
.
Relief is granted until such time as barge loading operations have concluded or through August
4, 2006, whichever occurs first .

The Illinois EPA is granting Marathon's request for provisional variance subject to the following
conditions
:
In lieu of the recordkeeping requirements of 35 III . Adm. Code 219.770,
Marathon shall keep the following records
:
a .
The number of barges loaded with gasoline or gasoline blend and the dates of
any such loading during the term of the provisional variance
.
b. The total tons of VOM emitted during gasoline and gasoline blend barge
loading operations conducted during the term of the provisional variance, with
supporting calculations .
Marathon shall submit to the Illinois EPA, by August 18, 2006, a report detailing
the information required by 1(a) and (b) above
.
