COMPLAINANT'S MOTION FOR EXTENSION OF TIME TO RESPOND TO
RESPONDENT'S MOTION TO DISMISS COMPLAINT
Complainant, People of the State .of Illinois,
(
"Complainant" or "People"), pursuant to 35 111.Adm.Code
101.500(d) moves the Illinois Pollution Control Board for
an extension of time to respond to Respondent Sheridan Sand
and Gravel
Co.'s ("Respondent") motion to dismiss
complaint, and in support thereof, states as follows:
1. Respondent filed a motion to dismiss on Friday,
July
7, 2006. Pursuant to 35 111.Adm.Code 101.500(d),
Complainant's response is to be filed on July 21, 2006,
fourteen (14) days after service. The Board rules allow
parties to request more time to respond by filing a motion
for an extension of time. 35

2. From Monday, July 10 through Wednesday, July 13,
2006, Counsel for the Complainant attended a prescheduled
mandatory Trial Advocacy program offered through the
ELECTRONIC FILING, RECEIVED, CLERK'S OFFICE, JULY 14, 2006

Attorney General's Office. During this time, Counsel's
attention was completely diverted, and therefore was unable
to prepare a response to Respondent's motion.
4. Complainant requests an extension of time to file
its response to
Respondent's motion to dismiss until July
WHEREFORE, Complainant, PEOPLE OF THE STATE OF
ILLINOIS, respectfully requests that the Board enter an
order
GRANTING its Motion for an Extension of Time to
Respond to Respondent's Motion to Dismiss Complaint until
July 28, 2006.
