    Based upon my legal judgment, experience, and observations at hearing, I find that the
    credibility of witness is not an issue in this matter.

    Complainant’s Exhibit 1 is the Inspection Digital Photo Sheet dated February 28, 2006,
    and Complainant’s Exhibit 2 is the open dump inspection checklist from the same date.
    Respondent’s Exhibit 1 is the Digital Inspection Photo Sheet dated January 20, 2005, and
    Respondent’s Exhibit 2 consists of five photographs taken on April 6, 2006.
    Briefing Schedule
    The transcript is due by July 17, 2006. Complainant’s brief is due by September
    8, 2006. Respondent’s brief is due by October 23, 2006. Complainant’s reply, if needed,
