Dear Chairman Girard :

Thank you for your May 10, 2006 letter requesting the Department of Commerce and

Economic Opportunity ("Department") to conduct an economic impact study concerning Illinois

Environmental Protection Agency's (EPA) proposal to add a new Part 225 to the Board's air

regulations to require Illinois coal-fired electrical generating units to begin utilizing control

technology for mercury to meet the standards established in the proposed rule beginning July 1,

2009 .

The Department has reviewed the Board's request for an Economic Impact Study for

EPA's proposal . Based on this review, and in light of continued fiscal constraints, the

Department has decided not to conduct a study of the economic impact of the above referenced

rulemaking proposal .
