    HEARING OFFICER ORDER
     
    On June 27, 2006, the parties participated in a telephone status conference with
    the hearing officer. A hearing was tentatively set for September 14-15, 2006. The parties
    hope that the Board will rule on the motion to dismiss no later than August 3, 2006, so
    that hearing plans may be finalized. Petitioner wants additional documents to be included
    in the Agency’s record. Petitioner and the Agency will attempt to resolve this issue
    informally, but if the parties disagree, petitioner must file a motion with the Board to
    supplement the record.
     
    The parties are directed to participate in a telephone status conference with the
    hearing officer at 2:00 p.m. on August 8, 2006. The status conference shall be initiated
    by the petitioner.
     
    The decision deadline is November 16, 2006.
