HEARING OFFICER ORDER
On June 22, 2006, all parties participated in a telephonic status conference with the
hearing officer. The complainant represented that the technical issues appear to be resolved, but
that the penalty amount is still being discussed. It was explained that a potential to emit issue is
outstanding and whether that issue is included in the settlement demand. By agreement, the
respondent’s answer is now due to be filed on or before August 18, 2006.
The parties or their legal representatives are directed to participate in a telephonic status
conference with the hearing officer on July 26, 2006, at 9:30 a.m. The telephonic status
conference must be initiated by the complainant, but each party is nonetheless responsible for its
own appearance. At the status conference, the parties must be prepared to discuss the status of
the above-captioned matter and their readiness for hearing.
