HEARING OFFICER ORDER
On June 22, 2006, all parties participated in a telephonic status conference with the
hearing officer. The respondents were directed to ascertain whether their respective
witnesses would be available for hearing for the weeks of September 18, 2006 and October
16 through November 3, 2006. The complainant’s represented that it was available for the
month of September 2006.
It is noted that the complainant sent a letter via facsimile to the hearing officer on
June 21, 2006, alleging inappropriate disclosure of settlement discussions on behalf of
respondent City of Morris. The complainant was directed to file a motion with the Clerk of
the Board addressing its concern if it intends to pursue the privilege issue.
The parties or their legal representatives are directed to participate in a telephonic
status conference with the hearing officer on June 29, 2006, at 1:00 p.m. Please note the time
change. The telephonic status conference must be initiated by the complainant, but each party
is nonetheless responsible for its own appearance. At the status conference, the parties must
be prepared to discuss the status of the above-captioned matter and their readiness for
hearing.
