HEARING OFFICER ORDER
On June 21, 2006, all parties participated in a telephonic status conference with the
hearing officer. Hearing dates were again discussed. Respondents objected to a bifurcated
hearing and also to the possibility for an evidence deposition in lieu of live testimony of its
expert witness Michael McDermont. McDermont filed an affidavit on June 13, 2006, stating he
is unavailable from September 17, 2006 through October 30, 2006. It is also noted that
respondents attorney is unavailable for much of September 2006 due to federal proceedings in
another matter. To that end, the parties were directed to ascertain their respective witness
availability from November 13, 2006 through the end of the year.
The parties or their legal representatives are directed to participate in a telephonic status
conference with the hearing officer on June 27, 2006, at 2:30 p.m. The telephonic status
conference must be initiated by the complainant, but each party is nonetheless responsible for its
own appearance. At the status conference, the parties must be prepared to discuss the status of
the above-captioned matters and their readiness for hearing.
