HEARING OFFICER ORDER
On June 5, 2006, the Office of the Attorney General, on behalf of the People of the State
of Illinois (People) filed a motion for an extension of the June 6, 2006 deadline to file public
comments
. The People filed the comment on June 8, 2006 .
While the Board had originally identified June 15, 2006 as its target date for adoption of a
second notice in this deadline-driven rulemaking, the Board believes the People's comment
merits additional time for Board deliberation and comment from other participants. The Board
grants the People's motion and accepts the public comment .
Additionally, the Board extends the public comment period for all participants, for the
specific and limited purpose of accepting responses to the People's public comment, through
June 29, 2006 . The mailbox rule will not apply, which means the Clerk's office must receive all
responses by 4 :30 p.m. on June 29, 2006 .
As a result of extending the public comment period, the Board expects to adopt a second-
notice order at the July 6 meeting. This will restrict the Board to the bare minimum time for
review by the Joint Committee on Administrative Rules and Board adoption and filing of the
final rule in August to complete rulemaking by the September 1, 2006 statutory deadline .
