ORDER OF THE BOARD (by S.T. Lawton, Jr.):
On January 30, 2001, Prairie Rivers Network appealed the decision by the Illinois
Environmental Protection Agency to issue a National Pollution Discharge Elimination System
permit to Black Beauty Coal Company for an extension of its mining operation in Vermilion
County, Illinois. On March 5, 2001, Vermilion Coal Company (VCC), by its attorney, filed a
motion with the Board to intervene in this proceeding. VCC subsequently filed a motion with
the Board on March 16, 2001, for a hearing on its right to intervene.
The Board directs VCC to provide more information on the basis of its motion to
intervene within seven days of the date of this order. The mailbox rule does not apply in this
instance. The Board, at this time, does not address the merits of either the motion by VCC to
intervene or its motion for a hearing on the matter.
