JURISDICTION
This Administrative Citation is issued pursuant to the authority vested in the Illinois
Environmental Protection Agency by Section 31 .1 of the Illinois Environmental Protection Act, 415
ILCS 5/31.1 (2004) .
FACTS
1 . That the Landfill L .L.C. is the permitted owner and operator and Danny Bowman is
the certified operator (collectively "Respondents") of a facility located at 1710 McFarland Road,
Thompsonville, Saline County, Illinois .

That said facility is a sanitary landfill, operating under Illinois Environmental
Protection Agency Permit No. 1999-295-LF, and is designated with Site Code No . 1650155005
.
The facility is commonly known to the Illinois Environmental Protection Agency as Galatia/West End
Disposal Facility
.
3 .
That Respondents have owned and/or operated said facility at all times pertinent
hereto
.

That on April 21, 2006, Robert Mileur of the Illinois Environmental Protection
Agency's Marion Regional Office inspected the above-referenced facility. A copy of his inspection
report setting forth the results of said inspection is attached hereto and made a part hereof
.
VIOLATIONS
Based upon direct observations made by Robert Mileur during the course of his April 21,
2006 inspection of the above-referenced facility, the Illinois Environmental Protection Agency has
determined that Respondents violated the Illinois Environmental Protection Act (hereinafter, the
"Act") as follows
:
(1) That Respondents conducted a sanitary landfill in a manner which resulted in uncovered
refuse remaining from the previous operating day or at the conclusion of any operating
day, a violation of Section 21 (o)(5) of the Act, 415 ILCS 5/21
(o)(5) (2004) .
(2) That Respondents conducted a sanitary landfill in a manner which resulted in the failure
to collect and contain litter by the end of each operating day, a violation of Section
21 (o)(1 2) of the Act, 415 ILCS 5/21 (o)(12) (2004) .
CIVIL PENALTY
Pursuant to Section 42(b)(4) of the Act, 415 ILCS 5/42(b)(4) (2004), Respondents are
subject to a civil penalty of Five Hundred Dollars ($500 .00) for each of the violations identified
above, for a total of One Thousand Dollars ($1000.00) .
If Respondents elect not to petition the
Illinois Pollution Control Board, the statutory civil penalty specified above shall be due and payable
no later than June 30, 2006, unless otherwise provided by order of the Illinois Pollution Control

If Respondents elect to contest this Administrative Citation by petitioning the Illinois Pollution
Control Board in accordance with Section 31 .1 of the Act, 415 ILCS 5/31 .1 (2004), and if the Illinois
Pollution Control Board issues a finding of violation as alleged herein, after an adjudicatory hearing,
Respondents shall be assessed the associated hearing costs incurred by the Illinois Environmental
Protection Agency and the Illinois Pollution Control Board. Those hearing costs shall be assessed
in addition to the statutory civil penalty .
Pursuant to Section 31 .1(d)(1) of the Act, 415 ILCS 5/31 .1 (d)(1) (2004), if Respondents fail
to petition or elect not to petition the Illinois Pollution Control Board for review of this Administrative
Citation within thirty-five (35) days of the date of service, the Illinois Pollution Control Board shall
adopt a final order, which shall include this Administrative Citation and a finding of violation as
alleged herein, and shall impose the statutory civil penalty specified above
.
When payment is made, Respondents' check shall be made payable to the Illinois
Environmental Protection Trust Fund and mailed to the attention of Fiscal Services, Illinois
Environmental Protection Agency, 1021 North Grand Avenue East, P .O. Box 19276, Springfield,
Illinois 62794-9276. Along with payment, Respondents shall complete and return the enclosed
Remittance Form to ensure proper documentation of payment
.
If any civil penalty and/or hearing costs are not paid within the time prescribed by order of
the Illinois Pollution Control Board, interest on said penalty and/or hearing costs shall be assessed
against the Respondents from the date payment is due up to and including the date that payment is
received. The Office of the Illinois Attorney General may be requested to initiate proceedings
against Respondents in Circuit Court to collect said penalty and/or hearing costs, plus any interest
accrued
.
PROCEDURE FOR CONTESTING THIS
ADMINISTRATIVE CITATION
Respondents have the right to contest this Administrative Citation pursuant to and in
accordance with Section 31 .1 of the Act, 415 ILCS 5/31/1 (2004). If Respondents elect to contest
this Administrative Citation, then Respondents shall file a signed Petition for Review, including a
Notice of Filing, Certificate of Service, and Notice of Appearance, with the Clerk of the Illinois
Pollution Control Board, State of Illinois Center, 100 West Randolph, Suite 11-500, Chicago, Illinois
60601 . A copy of said Petition for Review shall be filed with the Illinois Environmental Protection
i Agency's Division of Legal Counsel at 1021 North Grand Avenue East, P.O. Box 19276, Springfield,
Illinois 62794-9276. Section 31 .1 of the Act provides that any Petition for Review shall be filed
within thirty-five (35) days of the date of service of this Administrative Citation or the Illinois Pollution
Control Board shall enter a default judgment against the Respondents
.

Affant, Robert Mileur, being first duly sworn, voluntarily deposes and states as follows
:
1 . Affiant is a field inspector employed by the Land Pollution Control Division of the
Illinois Environmental Protection Agency and has been so employed at all times pertinent hereto
.
2. On April 21, 2006, between 9 :20 a.m. and 10:30 a.m ., Affiant conducted an inspection
of a disposal site operated by Danny Bowman, located in Saline County, Illinois, and known as
West End Disposal Facility by the Illinois Environmental Protection Agency . Said site has been
assigned site code number #1650155005 by the Agency
.
3. Affiant inspected said West End Disposal Facility site by an on-site inspection which
included walking and photographing the site .
4 . As a result of the material actions referred to in paragraph 3 above, Affiant completed
the Inspection Report form attached hereto and made a part hereof, which, to the best of Affiant's
knowledge and belief, is an accurate representation of Affiant's observations and factual
conclusions with respect to said West End Disposal Facility .

Landfill Inspection Report Narrative
Robert Mileur and Jay Winters representing the Agency inspected this site on April 21,
2005. The inspection consisted of a records check at the scale house followed by an
inspection of the landfill by walking and photographing the site
.
Inspection Findings
We arrived at the site at around 9:20am and met with Jackie Burlison who operates the
scale house. We reviewed the load check sheets, leachate records, daily cover log, and
landfill inspection checklist at that time . Manifest for special waste were checked as well
and it was noted that the facility has not taken any special waste since my last inspection
on December 16,2005 . Hauling records indicated that 71,906 gallons of leachate was
hauled the month of March . The rest of the records were in order and I did not see any
other discrepancies at that time .
Jay Winters and I then drove to the wheel wash and leachate collection tank area of the
landfill. We visually checked the condition of both structures and they appeared to be in
good condition at the time of the inspection
.
We then traveled to the active face of cell #1 and observed conditions, as they existed at
that time. We noted that, upon our arrival at 9 :20am to the landfill, we could see that the
trash from the previous day had not been covered . When we talked with Rick Lane up at
the active face, he told us that their only dirt hauling vehicle had broken down on the
previous day and that was the reason the trash was not covered . The landfill did have
their truck back in service at that time and had just started hauling dirt to cover the trash
.
Mr. Lane also told us that they were completely out of space in cell #1 and desperately
needed permit approval to start using cell #2. We could see by the amount of space they
had to work with on top and the side slopes that, they were close to running out of room
.
We did check the side slopes with a hand held slope meter and found a range of 2 :1 to 3 :1
on both the south and west facing slopes. The North Slope, which is a finished slope, did
meet the 3:1 slope as indicated in their permit. The east slope angle was good until you
got up to the access road which had a much steeper slope than the rest of the east side
.
There was very little wind at the time of inspection. The litter fences were sitting on the
east side of the active face and were located down grade . We did observe trash on the
north side of cell #1 as well as the south and east drainage ditches . The litter problem
seems to be an on going problem at the landfill
.
We did walk the perimeter of cell #1 and did not observe any leachate seeps at that time
.
We then returned to there scale house and met briefly with Rick Lane before exiting the
site .
We concluded our inspection at around 10:30am
