HEARING OFFICER ORDER
On June 6, 2006, petitioner participated in a telephone status conference with the hearing
officer. Respondent did not appear. This is a protective appeal that may not be needed
depending on the outcome of a related enforcement case filed in circuit court. Before the final
ruling in that case is issued, petitioner needs to perform additional work at the site. The work has
been delayed due to petitioner’s health problems.
If petitioner does not dismiss this appeal by December 31, 2006, the hearing officer will
set another status conference.
Petitioner filed an open waiver of the statutory decision deadline for this case.
