HEARING OFFICER ORDER
On December 22, 2005, the Board received a rulemaking proposal submitted by the
Illinois Environmental Protection Agency (Agency) pursuant to Section 27 and 28 of the Illinois
Environmental Protection Act (415 ILLS 5/27 and 28 (2004))
. The Agency proposes
amendments to Parts 218 and 219 of the volatile organic material rules to allow for the use of
add-on controls as a compliance option for printing operations using cold cleaning solvent
degreasing
. The Board accepted the proposal for hearing on January 19, 2006
.
The Agency and any interested parties are directed to participate in a telephonic status
conference on February 16, 2006, at 2
:00 p.m
. The Agency is responsible for initiating the status
conference .
On April 19, 2006 and May 17, 2006, hearings were held in this matter
. The first hearing
was held at the James R
. Thompson Center, 100 West Randolph Street, Suite 11-512 in Chicago
.
The second hearing was held at the Madison County Administration Building, Room 208,

North Main in Edwardsville
. At both hearings, Annet C
. Godiksen and Kimberly A
. Geving
appeared and participated on behalf of the Agency
.
The Agency offered the testimony of Gary E
. Beckstead at the hearings
. No public
comment was offered at the hearing
. The transcript of the first hearing was received at the Board
on April 27, 2006
. The transcript of the second hearing is expected to be available on May 24,
2006
. Public comments are due on or before June 14, 2006
. Ten exhibits were offered at the
hearings
. A summary of the exhibits offered at hearing and their disposition is contained in the
attached exhibit list .

After the first hearing, the Agency was directed to respond to a number of issues
. The
Agency filed a response to the issues on May 12, 2006
. At the hearing on May 17, 2006, the
Agency filed a motion to correct the transcript of the April 19, 2006
. The requested corrections
are non-substantive
. The motion to correct the transcript is granted
. Also on May 17, 2006, the
Agency provided an outreach mailing list compiled on May 15, 2006, that was accepted
as
Exhibit 9
. The persons on the list will be added to the notice list in this matter
.

The May 17, 2006 hearing also addressed the Board's February 22, 2006 request that the
Department of Commerce and Economic Opportunity (DCEO) conduct an economic impact
study for the rulemaking
. No study was submitted by the DCEO, and no comments concerning
the DCEO's decision not to perform a study were received at the hearing
.
Once the public comment period expires, the Board will review the record and consider
the proposal
