HEARING OFFICER ORDER

On May 18, 2006, Ameren Energy Generating Company, Amerenenergy Resources

Generating Company, Dynegy Midwest Generation, Electric Energy Incorporated, Kincaid

Generation, L.L.C . and Midwest Generation filed an emergency motion asking that the prefiling

deadline for questions for the hearings scheduled to begin on June 12, 2006, be suspended and

asking for a prehearing conference call to be scheduled on Wednesday, May 24, 2006 .

The prefiling deadline as established by the hearing officer's May 4, 2006 order is today .

Therefore, as this has been captioned an emergency motion, I ask that anyone wishing to respond

to the motion do so by 1 :00 PM today. Both fax and electronic filing of responses are approved

I expect to rule on this motion by no later than 3

:30 PM this afternoon .

To expedite this process, I will file the hearing officer order with the Clerk for posting in

COOL and I will e-mail the order to the names on the service list
