HEARING OFFICER ORDER
On May 11, 2006, NORA, an association of recyclers formerly known as the National Oil
Recycling Association and the proponent in this proceeding, orally sought an extension of the
May 11, 2006 deadline for the filing of prefiled testimony and the supplemental statement of
reasons requested in the Board's order of January 5, 2006
. Specifically, NORA requests an
extension of that deadline to Tuesday, May 16, 2006, and states that the Illinois Environmental
Protection Agency does not object to an extension of that duration
.
NORA's request is granted
. Accordingly, all testimony and related exhibits for the first
hearing must be submitted no later than Tuesday, May 16, 2006
. In addition, NORA is directed
to address in writing by May 16, 2006, the deficiencies in its rulemaking petition identified by
the Board in its January 5, 2006 order
.
The first hearing will take place as originally scheduled on Thursday, May 25, 2006, in
Springfield
. Because this extended deadline falls only nine days before the scheduled hearing
date, the "mailbox rule" at 35 Ill
. Adm. Code 101 .300(b)(2) does not apply, and the Clerk must
receive these documents on May 16, 2006
. However, prefiled testimony and other documents
may be filed electronically through COOL from the Board's Web site at
www.ipcb.state.il
.us.
