HEARING OFFICER ORDER
On March 16, 2006, and again on May 4, 2006, the parties participated in a
telephonic status conference with the hearing officer. The parties were informed that the
respondent’s proposed discovery schedule was accepted to the extent as follows. The
parties must meet and confer regarding objections to any pending written discovery and
any supplemental requests that will be served on or before May 19, 2006. Motions to
compel regarding currently pending written discovery requests must be filed on or before
June 5, 2006. Responses to written discovery must be served on or before June 28, 2006.
Fact discovery, including depositions of fact witnesses, must be completed on or before
August 4, 2006. Expert and/or opinion witness disclosure and expert reports must be
completed and served on or before August 21, 2006. Expert and/or opinion witness
depositions must be completed on or before September 11, 2006.
Attorney for the respondent represented that the former attorney, Steve Pearlman
has left the firm and that he, Todd Faulkner, will now be representing the respondent.
The parties or their legal representatives are directed to participate in a telephonic
status conference with the hearing officer on May 11, 2006, at 11:45 a.m. The telephonic
status conference must be initiated by the complainants, but each party is nonetheless
responsible for its own appearance. At the status conference, the parties must be
prepared to discuss the status of the above-captioned matter and their readiness for
hearing.
