HEARING OFFICER ORDER
On April 27, 2006, all parties participated in a telephonic status conference with the
hearing officer. The petitioner represented that it has received siting approval and that it is
awaiting a letter of completeness from the respondent. The respondent represented that it is
striving to receive and forward the letter to the petitioner. Upon receipt of the letter, the
petitioner represented that it will file a motion to voluntarily dismiss the above-captioned matter.
The petitioner represented that it will file a 30-day waiver of the statutory decision deadline.
The parties or their legal representatives are directed to participate in a telephonic status
conference with the hearing officer on May 24, 2006, at 11:45 a.m. The telephonic status
conference must be initiated by the petitioner, but each party is nonetheless responsible for its
own appearance. At the status conference, the parties must be prepared to discuss the status of
the above-captioned matter and their readiness for hearing. If, however, a motion to voluntarily
dismiss is filed prior to the next status conference, the conference will be cancelled without
further order.
