    HEARING OFFICER ORDER
     
    On April 24, 2006, petitioner participated in a telephone status conference with the
    hearing officer. Respondent did not appear. Petitioner was under the impression that a tentative
    agreement had been reached with respect to the new permit terms. Respondent’s permitting
    division is now raising new issues. According to petitioner, respondent’s attorney was planning
    to speak to the permitting division to discuss a possible resolution of the new issues. If the new
    issues cannot be resolved, this case may be set for hearing.
     
    The parties are directed to participate in a telephone status conference with the hearing
    officer at 10:00 a.m. on May 23, 2006. The status conference shall be initiated by the petitioner.
     
    Petitioner filed an open waiver of the statutory decision deadline.
