HEARING OFFICER ORDER
On April 3, 2006, the Illinois Environmental Protection Agency (Agency) filed a motion
"Concerning Guidelines and Format of First Hearing". Three responses were received, two on
April 17, 2006, and a third on April 18, 2006. The first response was from Ameren Energy
Generating Company, AmerenEnergy Generating Company, and Electric Energy Inc . The
second response was from Dynegy and Midwest Generation. The third response was from
Kincaid Generation, L.L.C. None of the responses object to the Agency's requested order of
hearing. However all object to the schedule requested by the Agency and the potential limited
ability to cross-examine witnesses
.
The Board's rules allow a hearing officer to schedule a preheating conference to attempt
to identify and limit issues of disagreement among the participants to promote efficient use of
hearing time. 35 Ill. Adm. Code 102.404(b) and 102.406(c). Given the pending motions before
the hearing officer, it is clear that a prehearing conference will be beneficial to address
scheduling and witness availability. Therefore, a preheating conference is scheduled for April
26, 2006, at 10 a.m. In order to facilitate as much participation as possible, the preheating
conference will be held by videoconference at both the Board's Chicago office and the Board's
videoconference room in Springfield . Anyone may participate and need merely appear at one of
the two videoconference facilities to participate
.
