DISSENTING OPINION (by G.T. Girard and E. Dunham)

We respectfully disagree with the majority decision regarding reconsideration . We

would grant the motion to reconsider filed by petitioner and, for the reasons expressed in our

March 21, 1996 dissent, reverse the Agency's denial of permits for Watts' Taylor Ridge

facility. We do agree that the respondent's motion to reconsider was properly denied as the

motion has not pointed to any error in the Board's original decision nor presented new facts or

arguments regarding the Agency's position
