FACTS
1
. The Respondent is the present owner and occupant and in control and possession
of a facility located in the County of Jackson, State of Illinois
.
2
. The facility is an open dump, operating without an Illinois Environmental Protection
Agency Operating Permit, and designated with the Site Code # 0778005006
. The facility is
known to the Agency as the Ava/James Qualls site
.
3
. The Respondent has owned, occupied, controlled and/or operated the facility at all
relevant times hereto
.
4
. On February 28, 2006, Don Terry, Field Inspector, Jackson County Health
Department, inspected the facility
. A true and correct copy of the inspection report, along with
Mr
. Terry's affidavit, are attached and incorporated herein by reference as Exhibit A
.

 
5. On March 6, 2003, the Illinois Pollution Control Board in docket numberAC 03-14
entered an order and found this same Respondent, James Qualls, had violated sections
21(p)(1), 21(p)(5), and 21
(p)(7) of the Illinois Environmental Protection Act, 410 ILLS 5/1
et.
seq.
on this same site pursuant to an Administrative Citation filed bythis same Complainant,
County of Jackson .
VIOLATIONS
On the basis of Field Inspector, Don Terry's, direct observation, he has determined that
the Respondent has caused or allowed open dumping at the above described facility in a
manner that resulted in the following violations
:
That on February 28, 2006, an on-site inspection of the facility disclosed the following
:
1
. The Respondent has caused or allowed litter at the facility in violation of 415 ILCS
5/21(p)(1); and
2
. The Respondent has caused or allowed the deposition of general construction or
demolition debris
; or clean construction or demolition debris at the facility in violation of 415
ILCS 5/21(p)(7) .
CIVIL PENALTY
In accordance with 415 ILCS 5/42(b)(4-5), the Respondent is subjectto a civil penalty
of $3,000.00
foreach second or subsequent violation
. Additionally, should the Respondent
electto petition the Illinois Pollution Control Board underthe review process described below,
afteran adjudicatory hearing, the Respondent shall be assessed the hearing costs incurred
by the Pollution Control Board
. The hearing cost would be in addition to the $6,000
.00 fine
.

 
If you acknowledge the violations cited herein above, the civil penalty shall be due and
payable no later than May 1, 2006
. If you do not petition the Pollution Control Board for review
of the Administrative Citation within 35 days of service of the Administrative Citation, or
contest the Citation, anyjudgment that maybe rendered against you shall specifythe due date
of the civil fine and any additional costs assessed against you
.
When payment is made, yourcheck should be made payable to the Jackson County's
Treasurer Office and mailed to the attention of Shirley Dillinger Booker, Jackson County

. Also, please complete and return the enclosed
remittance form, along with your payment, to assure proper credit

If any civil penalty is not paid within the prescribed time, the law allows for the
accumulation and payment of interest on the remaining unpaid balance
. If any civil penalty is
not paid when due, the Office of the State's Attorney shall be requested to initiate proceedings
in Circuit Court to collect the penalty
. In addition to the civil penalty, hearing costs, and
interest, if any, the Jackson County State's Attorney may seek to recover their costs of
litigation .

During the stated date and time, I conducted an inspection of the site fisted above. This inspection
was made as a follow up to an inspection conducted on June 28, 2004 during which violations
regarding open dumping were observed . I was accompanied on this inspection by Bart Hagston of
the Jackson County Health Department . Weather conditions at the time of the inspection were :
cloudy with calm winds and a temperature of approximately 63°F .
According to the Jackson County Assessor's Office, the site is owned by James Qualls .
Upon arrival at the site, Mr . Hagston and I called out in loud voices for Mr . Qualls to determine if
anyone was home . After several loud calls we received no response.
From Wilson Road, a public roadway, I observed a waste pile to the north of the house (Photos #1
& #2, Site Sketch Area A) consisting of, but not limited to, dimensional lumber, plastic buckets,
scrap metal, cardboard, furniture, waste tires and other materials .
South of this pile, I observed another waste pile (Photos #3 & #4, Site Sketch Area A) consisting
of, but not limited to, scrap metal, ceramic insulators, furniture, waste tires and other materials .
West of Wilson Road (and on property owned by James Qualls) I observed two mobile homes
which appeared abandoned (Photo #5, Site Sketch Area B)
. I observed no evidence of utility
hook ups to either mobile home or evidence of recent use (ie paths through tall grass to the mobile
home). In the same area (Area B on Sketch) I observed several vehicles which appeared
abandoned (Photos #5 & #6, Site Sketch Area B) since at the time of the inspection, these vehicle
were not in use, were not useable in their current condition, and were not stored in such a way as to
protect any future use.

I walked south along Wilson Road to a location a the south end of the Quails property. I walked
east where I observed a pile of approximately sixty waste tires (Photo #7, Site Sketch Area
C) .
To the west of the tire pile I observed two other waste piles consisting of, but not limited to, waste
tires, dimensional lumber, plumbing fixtures, power lawn mowers, scrap metal, general construction
/ demolition debris and other materials not readily identifiable (Photos #8
- #10, Site Sketch
Area C).
I walked east through a field where I observed an abandoned truck (Photos #11
&
#12, Site
Sketch Area D)
.
The truck was lacking current Illinois vehicle registration (Photo #12, Site
Sketch Area D) and the bed was filled with waste (Photo #11, Site Sketch Area D).
I walked east to a location where I had observed open dumped waste during a previous inspection
(Site Sketch Area E) . This area is located along a dirt pathway and is approximately 300 yards
long. I began at the south end of the open dumping area and walked north . Along this dirt pathway
I observed the following items open dumped : scrap metal, 25 vehicles, two pull behind camper
trailers (open to the environment), one mobile home (side missing and open to the environment),
metal barrels, waste tires, dimensional lumber, plastic items, cloth items, furniture, and other items
too numerous to list . The total amount of waste in this area (Area E on Site Sketch) was
approximately 500 cu / yds . At the time of the inspection, the items observed at this site were not
in use, were not useable in their current condition, and were not stored in such a way as to protect
any future use .
