On December 13, 2005, the Board received a proposal (Prop .) to amend Parts 808 and
809 of the Board's regulations concerning special waste classifications and nonhazardous special
waste hauling as they pertain to used oil recycling in Illinois . 35 111 . Adm
. Code 808, 809 . The
proposal was filed by NORA, which states that it is an association of responsible recyclers
formerly known as the National Oil Recycling Association
. In an order dated January 5, 2006,
the Board accepted this matter for hearing and identified three specific deficiencies in the
rulemaking petition . In the same order, the Board directed NORA to address those deficiencies
in writing prior to any scheduled hearing as directed by the hearing officer
.

The hearing officer assigned to this rulemaking is Tim Fox at (312) 814-6085 or
foxt(a'ipcb.state.ilus . The Board will hold at least two hearings in this matter . After
consultation with counsel for NORA and the Illinois Environmental Protection Agency (Agency)
on the procedural issue of scheduling hearings, the hearing dates above are the first for which
witnesses for NORA and the Agency are all expected to be available.
Both hearings will be conducted to allow the proponent and any other interested parties
the opportunity to present testimony on the merits and economic impact of the rulemaking
proposal. At hearing, all person who testify will be sworn in and subject to questioning . The
Board will also receive any testimony on any economic impact study (EelS) conducted by the
Department of Commerce and Economic Opportunity (DCEO) on the proposed rules or DCEO's
decision not to perform an EcIS .
The Service List for this rulemaking is the list of persons who wish to participate actively
in this proceeding and receive not only the Board's opinions and orders, but also other filings
such as prefiled testimony and public comments
. The Notice List is the list of person who wish
to receive only the Board's opinions and orders and the hearing officer orders. Note that
interested persons may now request electronic notice of filings by providing their e-mail address
through the Clerk's Office On-Line (COOL) under this docket number R06-20
. This electronic
notice includes the filing of documents that are not typically provided to persons on the notice
list
. Through COOL, those documents may be viewed, downloaded, and printed free of charge

Persons who plan to testify at the first hearing must prefile their testimony and serve the
testimony on the hearing officer and all person on the service list
. Before filing prefiled
testimony or any other document with the Clerk, please check for the most recent version of the
service list with Ms . Sandy Wiley at (312) 814-3623 or at wileys(~,)ipcb .state.il.-us, the hearing
officer, or the Clerk's Office .
All testimony and any related exhibits for the first hearing must be submitted no later
than Thursday, May 11, 2006
. In addition, NORA is directed to address in writing by Thursday,
May 11, 2006 the deficiencies in its rulemaking petitions identified by the Board in its January 5,
2006, order. Because this deadline falls only 14 days before the hearing date, the "mailbox rule"
at 35 Ill. Adm. Code 101 .300(b)(2) does not apply and the Clerk must receive these documents
on May 11, 2006
. However, prefiled testimony and other documents may be filed electronically
though COOL from the Board's Web site at www.ipcb .state.il.us. Any questions about
electronic filing through COOL should be directed to the Clerk's Office at (312) 814-3629
