HEARING OFFICER ORDER
On March 30, 2006, the parties informed the hearing officer that this matter
is proceeding and that additional sampling will be performed at the site. The results of
the sampling will be forwarded to the Illinois Environmental Protection Agency for its
review. The respondents, Wooten Construction, Ltd., and Smithfield Properties L.L.C.,
have expressed their optimism that this matter will be resolved without the necessity of a
hearing.
The parties or their legal representatives are directed to appear at a telephonic
status conference with the hearing officer on May 24, 2006, at 9:15 a.m. The telephonic
status conference must be initiated by the complainant, but each party is nonetheless
responsible for its own appearance. At the conference the parties must be prepared to
discuss the status of the above-captioned matter and their readiness for hearing.
