This letter is in response to your request for an update on the status of the United States

proceeding . As Commonwealth Edison Company stated in its Motion to Stay, USEPA is in the
process of making a CBI determination concerning the same information that is at issue in PCB
04-215 .
Recently, we spoke with counsel for USEPA about the status of USEPA's
determination . CurnenUy . USEPA expects that it will issue a determination within two to three
months .
We also note that, in October 2005, USEPA received oGubsequent FOIA request from the
Sierra C!ub, and we understand that USEPAwiU be issuing a determination in that matter as
