WAIVER OF DECISION DATE
 
 
 
NOW COMES Petitioner, Midwest Generation, LLC, Waukegan Generating
Station, by and through its attorneys, Schiff Hardin LLP, and waives the Board’s
statutory decision date in this matter for approximately 180 days from the filing date until
September 7, 2006, the same date as noted in Waivers of Decision Date in the five other
permit appeal cases filed by Midwest Generation, LLC’s Generating Stations, PCB 06-
056 – 06-060. On March 16, 2006, during the status call with the hearing officer for PCB
06-056 – 06-060, Mr. Bradley Halloran, the Illinois Environmental Protection Agency,
attorneys for Midwest Generation agreed to submit this waiver to conform the timing of
appeal of the CAAPP permit for the Waukegan Generating Station to that of the other,
related permit appeals, as the permits and issues appealed are virtually the same in all
cases.
