You have asked that I update you on the status of the United States Environmental
Protection Agency ("USEPA") proceedings related to the USEPA's determination as to the confidential
or trade secret status of the same documents at issue in the above referenced matters . On Monday March
20, 2006, Byron Taylor, counsel for Commonwealth Edison Company in PCB 04-215, and I called
USEPA to discuss the status of
its determination
. USEPA advised us that the determination was still
pending and info-orally estimated that the determination would be finalized in three months .

In October 2005, USEPA received a subsequent FOIA request from the Sierra Club for
ditional information- The USEPA will he issuing a determination in this matter
as well.
