HEARING OFFICER ORDER
On March 1, 2006, the petitioner informed the hearing officer that the related
matter is fully briefed and is awaiting a decision by the appellate court. The outcome of
the related appellate matter will affect the proceedings in the above-captioned matter.
The petitioner represented that it will file a 90-day waiver of the statutory decision
deadline.
The parties or their legal representatives are directed to participate in a telephonic
status conference with the hearing officer on June 8, 2006, at 11:00 a.m. The telephonic
status conference must be initiated by the petitioner, but each party is nonetheless
responsible for its own appearance. At the status conference, the parties must be
prepared to discuss the status of the above-captioned matter and their readiness for
hearing. If, however, a motion to dismiss is filed prior to the next status conference,
IT IS SO ORDERED.
