On January 20, 2006, the Illinois Environmental Protection Agency (Agency) filed a
proposal to add a new Part 1505 to the Board's regulations setting standards and requirements for
potable water well surveys and for community relations activities, where appropriate, in response
to impacts or threats from contamination. Public Act 94-314 added a new Title VI-D (Right-To-
Know) to the Environmental Protection Act (Act). Public Act 94-314 requires the Board to
adopt well survey and community relations rules within 240 days of the effective date of P .A. 94-

314, or no later than September 17, 2006 . The Board meeting immediately before that date is
scheduled for September 7, 2006. The Board discusses the proposal in more detail below
.
The Board will hold at least two hearings in this matter . Both hearings will be conducted
to allow the proponent and all other interested parties the opportunity to present testimony on the
merits and economic impact of the rulemaking proposal . At hearing, all persons who testify will
be sworn in and subject to questioning. The Board will also receive any testimony on any
economic impact study (EcIS) conducted by the Department of Commerce and Economic
Opportunity (DCEO) on the proposed rules or, alternatively, any DCEO decision not to perform
an EcIS .
The Agency's proposal (R06-23), including the statement of reasons and proposed rule
language, may be obtained on the Board's website through the Clerk's Office On-Line (COOL)
atwww.ipcb.state. il.us.
The "Notice List" is the list of interested persons who wish to receive only the Board's
opinions and orders and hearing officer orders in this proceeding . The "Service List" is the list of
persons who wish to participate in the proceeding and receive not only opinions and orders, but
also all prefiled testimony and public comments . To be placed
on
either the Notice List or the
Service List please contact either the hearing officer or Ms . Sandy Wiley by email or by phone as
provided below

Anyone who plans to testify at either hearing must prefile their testimony . All testimony
for the first hearing must be submitted no later than Tuesday, March 14, 2006 . All testimony for
the second hearing must be submitted no later than Tuesday, May 9, 2006 . Timely submission of
these materials by all persons is essential for the Board to meet the statutorily imposed deadline
of September 17, 2006

officer and on those persons on the Service List for this rulemaking . Before filing any document
