Thank you for your January 10, 2006 letter requesting the Department of Commerce and

Economic Opportunity ("Department") to conduct an economic impact study concerning the

proposed Amendments to Regulation of Petroleum Leaking Underground Storage Tanks (35 Ill .

Adm. Code 732) and Regulation of Petroleum Leaking Underground Storage Tanks (Proposed

New 35 Ill. Adm. Code 734)

.

The Department has reviewed the Board's request for an Economic Impact Study for this

proposal. Based on this review, and in light of continued fiscal constraints, the Department has

decided not to conduct a study of the economic impact of the above referenced rulemaking

proposal

.
