HEARING OFFICER ORDER
On February 9, 2006, all parties participated in a telephonic status conference with the
hearing officer. A brief discussion was held regarding respondent’s November 30, 2005, motion
for extension of time and the January 13, 2006, filings of the respondent, that included a
response to the complaint (apparently an answer), respondent’s response to motion to deem facts
admitted and for summary judgment, and a motion for an extension of time to file respondent’s
response to deem facts admitted and for summary judgment. On December 9, 2005, respondent
served the hearing officer a response to the complaint, respondent’s response to motion to deem
facts admitted and for summary judgment. The respondent failed to serve these pleadings on the
complainant nor did the respondent serve the Clerk of the Board.
As reflected in the hearing officer order of January 12, 2006, none of respondent’s
pleadings had been properly served as of January 12, 2006. Respondent was directed to properly
file and serve his pleadings. It appears that as of January 13, 2006, those pleadings have now
been properly filed and served. No ruling has been made on the pleadings filed on January 13,
2006. The complainant represented that it will stand on the response it filed on December 15,
2005.
The hearing officer continued this matter to the date and time noted below so that he may
review respondent’s motion for extension of time and complainant’s response.
The parties or their legal representatives are directed to participate in a telephonic status
conference with the hearing officer on March 9, 2006, at 1:00 p.m.. The telephonic status
conference must be initiated by the complainant, but each party is nonetheless responsible for its
own appearance. At the status conference, the parties must be prepared to discuss the status of
the above-captioned matter and their readiness for hearing.
