    ORDER OF THE BOARD (by G.T. Girard):
     
    On October 6, 2005, at the parties’ request, the Board extended until January 3, 2006, the
    time period for Eaves Auto Repair to appeal an August 29, 2005 determination of the Illinois
    Environmental Protection Agency (Agency).

    415 ILCS 5/40(a)(1) (2004); 35 Ill. Adm. Code
    101.300(b), 105.402, 105.406. The Agency rejected the high priority corrective action plan
    budget for Eaves Auto Repair’s leaking underground petroleum storage tank facility located at
    538 South Railroad Avenue, Paxton, Ford County. Because petitioner failed to timely file an
    appeal, the Board dismisses this case and closes the docket.
