    HEARING OFFICER ORDER
     
    On January 18, 2006, the parties participated in a telephone status conference with the
    hearing officer. The parties report that they have reached a settlement agreement. Accordingly,
    the hearing set for January 20, 2006 is cancelled. Petitioner is directed to file another decision
    deadline waiver no later than February 3, 2006 if the motion to dismiss is not filed by that time.
    Petitioner has agreed to withdraw the motion for sanctions as part of the settlement agreement.
     
    The parties are directed to participate in a telephone status conference with the hearing
    officer at 9:30a.m. on April 4, 2006. Petitioner shall initiate the call.
     
    The decision deadline is May 4, 2006.
      
    IT IS SO ORDERED.
