    ORDER OF THE BOARD (by T.E. Johnson):
     
    On November 2, 2005, Soyland Power Cooperative, Inc. (Soyland) timely filed a petition
    asking the Board to review a September 29, 2005 determination of the Illinois Environmental
    Protection Agency (Agency) to issue a Clean Air Act Permit Program (CAAPP) permit with
    conditions.

    415 ILCS 5/40.2(a) (2004); 35 Ill. Adm. Code 105.302(e). Soyland is
    challenging numerous conditions, including conditions relating to emission limits, sampling and
    monitoring requirements, and conditions containing incorrect information. The CAAPP permit
    application concerns Soyland’s electrical power generating station located near the town of
    Pearl, Pike County. The Board accepted the petition for hearing on November 17, 2005.
     
    In the petition, Soyland requested a stay of the effectiveness of the provisions and
    conditions appealed in the permit. On November 16, 2005, the Agency filed a motion in support
    of the requested stay. In the motion, the Agency asserts that because Soyland is seeking limited
    stay of the CAAPP permit confined only to those permit conditions being challenged in the
    petition, the Agency is agreeable to the stay. Mot. at 3. Accordingly, the Board grants the
    motion to stay the effectiveness of the provisions and conditions appealed in the permit.
