MOTION TO POSTPONE HEARING
COMES NOW, RESPONDENT JEFFREY S . GRELYAK, by his attorney George W

Tinkham, and moves Illinois Pollution Control Board Hearing Officer Bradley P . Halloran to
postpone the hearing in this matter now scheduled to be held on 25 January 2006 . In support of
this Motion, George Tinkha°n states as follows
:
1 . After numerous communications between Mr . Tinkham and Jeremy Shaw, attorney for
Complainant, it appears there is substantial potential for an agreement between the parties .
2 .
To work out an agreed resolution of this matter, additional draft proposals need to be
reviewed by the parties . Also, a face-to-face meeting is being planned

The details outlined in #2 above take time, and there is not enough time between now and
January 25ti'
both to engage in settlement efforts and to prepare for trial.
4 .
Jeremy Shaw has informed George Tinkham that he (Jeremy Shaw) does not oppose this
request to postpone the hearing
.
NOW, THEREFORE, RESPONDENT asks that the hearing now scheduled in this matter on 25
January 2006 be postponed until it is clear that all attempts at settlement have been exhausted
.
The parties should know by 31 January 2006 if they will settle or if this should go to trial .
