HEARING OFFICER ORDER
On January 12, 2006, all parties participated in a telephonic status conference with the
hearing officer. The respondent represented that it will properly file and serve his motion for an
extension of time, filed November 30, 2005. That motion was not properly served on the
complainant. The respondent represented that he will also properly file and serve his response to
complaint and response to motion to deem facts admitted and for summary judgment that was
served on the hearing officer and the complainant on or about December 9, 2005, but was not
filed with the Clerk. The respondent anticipates that the above-mentioned activities will be
completed on or before January 19, 2006. As yet, no ruling has been made on those pleadings.
The respondent is again reminded to file and serve the pleadings in accordance with
Section 101.304 of the Board’s procedural rules.
The parties or their legal representatives are directed to participate in a telephonic status
conference with the hearing officer on February 9, 2006, at 1:00 p.m. The telephonic status
conference must be initiated by the complainant, but each party is nonetheless responsible for its
own appearance. At the status conference, the parties must be prepared to discuss the status of
the above-captioned matter and their readiness for hearing.
