HEARING OFFICER ORDER
On January 12, 2006, all parties participated in a telephonic status conference
with the hearing officer. The parties represented that the stipulation and proposal for
settlement (stipulation), is ready to be filed in the near future; however, questions remain
regarding the bankruptcy posture of this matter. The parties were directed to file a joint
status report outlining the outstanding issues that need to be addressed prior to the filing
of the stipulation. The parties were directed to file their joint status report on or before
January 19, 2006. To that end, respondent’s answer is now due to be filed on or before
March 2, 2006.
The parties or their legal representatives are directed to participate in a telephonic
status conference with the hearing officer on February 9, 2006, at 9:15 a.m. The
telephonic status conference must be initiated by the complainant, but each party is
nonetheless responsible for its own appearance. At the status conference, the parties
must be prepared to discuss the status of the above-captioned matter and their readiness
for hearing. If, however, a stipulation is filed prior to the next status conference, the
conference will be cancelled without further order.
