Amendment to Provisional Variance Granted December 21, 2005 to the
Salt Creek Sanitary District
Dear Mr. Halm :
On December 21, 2005, the Illinois Environmental Protection Agency (Agency) granted
the Salt Creek Sanitary District (District) a provisional variance from limits on Monthly
Averages and Daily Maximums for Total Suspended Solids (TSS) and CBOD5 of
NPDES Permit IL0030953 . The District had requested the provisional variance in order
to complete the tertiary building modifications, which necessitates taking the tertiary
filters out of service. This is the final step in the project to improve the facility's
treatment capabilities with respect to nitrification .
The District submitted it request for a provisional variance on December 1, 2005, and
amended its request by fax on December 21, 2005 (Attachment A)
.

In the amended
request, the District asked that the provisional variance start on December 21, 2005, and
also sought relief from the daily maximum permit limit for Ammonia Nitrogen in
NPDES Permit IL0030953. The Agency inadvertently omitted to address the parameter
for Ammonia Nitrogen in Provisional Variance IEPA-06-10, which granted relief from
the permit limitations for TSS and relating to CBOD5
.
By this letter, the Agency amends Provisional Variance IEPA-06-10 to include relief
from the daily maximum limit for Ammonia Nitrogen, subject to certain conditions
.

Agency Determinations
The Agency has reviewed the requested provisional variance from the permit limits for
Ammonia Nitrogen and has concluded the following
:
1 . The environmental impact from the requested relief is predicted to be minimal
;
2. No other reasonable alternatives appear available
;
3. No public water supplies will be affected
;
4. No federal regulations will preclude the granting of this request; and
5. The District will face an arbitrary and unreasonable hardship if the request is not
granted
.
Special Conditions
In this Addendum, the Agency amends Provisional Variance IEPA-06-10 to include relief
from the daily maximum permit limit for Ammonia Nitrogen in NPDES Permit
IL0030953, subject to the following conditions
:
A. The District can exceed the daily maximum limit of 8 .0 mg/l for Ammonia
Nitrogen between December 21, 2005, and up to and including February
4, 2006
.
B. The District shall operate its system to produce the best effluent possible,
and at no time shall the District exceed a daily maximum limit of 15
.0
mg/1 for Ammonia Nitrogen .
The District shall continue to monitor and maintain compliance with all other parameters
and conditions specified in its NPDES Permit No . IL0030953 and Provisional Variance
IEPA-06-10 .
Conclusion
The Agency amends Provisional Variance IEPA-06-10 to include relief from the daily
maximum permit limits for Ammonia Nitrogen contained in NPDES Permit
IL0030953
.
The decision to amend the provisional variance is not intended to address
compliance with any other applicable laws or regulations
.

Dear Roger :
Walter E. Deuchler Associates, Inc. on behalf of the salt Creek Sanitary District (SCSD) is
requesting the provisional variance requested in our December 1, 2005 Iettr to begin on Wednesday
December 21, 2005 rather than December 27, 2005
.
As you discussed today with Mr. Fred Dale, Manager of SCSD, the SCSD is also requesting a
provisional variance from NPDES permit 110030953: AmmoniaNitrogcn as (N), monthly average
2.5 mg/1, weekly average 6.3 mg/I and daily maximum of 8 .
0
mg/l. We anticipate during the
provisional variance period to have daily maximum Ammonia Nitrogen as (N) discharges of 15 .0
mg/I.
