WAIVER OF DECISION DEADLINE

Pursuant to 35 111. Adm. Code 101 .308, Petitioner Basic Wire & Cable ("BWC")

hereby preemptively waives the statutory decision deadline

(See

415 ILCS 5/40(a)(2)

(2004)) that will be set by the Illinois Pollution Control Board ("Board") if it accepts

BWC's December 13, 2005 Petition for Review. BWC previously filed another petition

(PCB No. 05-198) regarding the same subject matter at issue in this case, and a decision

deadline of June 14, 2006 has been set for that prior appeal. In congruence with that

prior, related appeal, BWC preemptively moves to extend to June 14, 2006 any decision

deadline set for an earlier date by the Board for this appeal
