AGENCY’S COMMENTS

 

The Illinois Environmental

Protection Agency (“Agency”) respectfully submits its

comments in the above-captioned matter to the Illinois Pollution Control Board

(“Board”) pursuant to 35 Ill. Adm. Code 102.108 and 102.610 and the Board’s Opinion

and Order of October 20, 2005.

In response to the Board’s request for comments on amendments to 35 Ill. Adm.

Code 720, the Agency would like to comment that the reference to NFPA 30 in 35 Ill.

Adm. Code 720.111 still limits use to using the 1987 version of the document. The

Agency believes this would be a good opportunity to update the reference to the most

current version of the document, which is NFPA 30: Flammable and Combustible

Liquids Code, 2003 Edition.

In response to the Board’s request for comments on amendments to 35 Ill. Adm.

Code 721, the Agency would request a clarification on Section 721.134(d)(5). That

Section states, in pertinent part, “During the interim period, from the point of generation

to completion of the hazardous waste determination, the generator must store the wastes

appropriately.” The Agency would like the Board to clarify if this means that the wastes

must be stored in accordance with 35 Ill. Adm. Code 722.134 or if some other standard

would be used to determine what appropriate storage methods would be.

This concludes the Agency’s comments on the consolidated proposal.
