PETITIONER'S MOTION TO CORRECT A FACTUAL ERROR

NOW COMES the Petitioner

. DYNEGY MIDWESTGENERATION, INC . (BALDWIN

ENERGY COMPLEX) ("Petitioner"). by and through its attorneys, and moves the Illinois

Pollution Control Board ("Board") to deem amended Petitioner's recently tiled Reply in Support

of a Permit Stay and in Response to the Agency's Opposition to Petitioner's Request for a Stay

(the "Reply") to correct a factual error set forth therein

. In support of this motion, Petitioner

states as follows :

On December 2, 2005, Petitioner filed its Reply .

As filed with the Board on December 2, 2005, the Reply contains an error that

requires correction

. Specifically, footnote I on page 1 of the Reply incorrectly identifies the

address of the Baldwin Energy Complex as #1 Chessen Lane, Alton, Madison County, Illinois

62002

. The correct address of the Baldwin Energy Complex is 10901 Baldwin Road, Baldwin,

Randolph County, Illinois 62217

. In that regard, the November 17, 2005 order in this matter

identifies the correct address for the Baldwin Energy Complex

.

This error should he corrected to avoid any confusion regarding the correct

location of the Baldwin Energy Complex

.
