    HEARING OFFICER ORDER
     
    On November 22, 2005, the parties participated in a telephone status conference
    with the hearing officer. Petitioner has received an interim ruling in the related
    enforcement case filed in circuit court. While it appears that the final ruling will render
    this permit appeal moot, petitioner would prefer to wait until the final ruling before filing
    a motion to dismiss. Petitioner hopes to have the final ruling next month.
     
    The parties are directed to participate in a telephone status conference with the
    hearing officer at 11:00 a.m. on January 19, 2006. The call shall be initiated by
    petitioner.
      
    Petitioner filed an open waiver of the statutory decision deadline for this case.
