HEARING OFFICER ORDER
On November 17, 2005, all parties participated in a telephonic status conference with the
hearing officer. The respondent represented that it has received a bid on the supply and
installation of the low sound blade package to be installed at the site. The respondent appears
optimistic that this remedy will resolve the outstanding issues. The respondent represented that
the Board of Education must, however, ratify the contract, and should be voted on at the next
board meeting. The respondent represented that it will attempt to discern the possible start date
of the installation and whether the package is readily available prior to the next status
conference.
The parties were notified that, if needed, continuing with the discovery process will be
revisited at the next status conference.
The parties or their legal representatives are directed to participate in a telephonic status
conference with the hearing officer on December 15, 2005, at 3:00 p.m. The telephonic status
conference must be initiated by the complainant, but each party is nonetheless responsible for its
own appearance. At the status conference, the parties must be prepared to discuss the status of
the above-captioned matter and their readiness for hearing.
