HEARING OFFICER ORDER
On November 17, 2005, all parties participated in a telephonic status conference with the
hearing officer. The petitioner represented that it is still having internal discussions regarding
the selling of the site and remediation responsibility. The parties, however, represented that they
have an agreement in substance.
The parties are directed to participate in a telephonic status conference with the hearing
officer on December 15, 2005, at 9:45 a.m. The status conference must be initiated by the
petitioner, but each party is nonetheless responsible for its own appearance. At the status
conference, the parties must be prepared to discuss the status of the above-captioned matter and
their readiness for hearing. If, however, a motion to voluntarily dismiss is filed prior to the next
status conference, the conference will be cancelled without further order.
