    HEARING OFFICER ORDER
     
    On November 7, 2005, the parties were scheduled to participate in a telephone
    status conference that was rescheduled from November 3, 2005. Neither party appeared.
    The parties continue to wait for the Board’s ruling on the motions for summary judgment.
     
    The parties are directed to participate in a telephone status conference with the
    hearing officer at 1:30 p.m. on January 3, 2006. The status conference shall be initiated
    by the petitioner. If petitioner would like an earlier status conference, it may contact the
    hearing officer.
     
    Petitioner filed an open waiver of the decision deadline in this matter.
