HEARING OFFICER ORDER
On October 20, 2005, the Board limited the scope of hearing to Count I of the complaint.
The Board’s order further directed the hearing officer to resolve the remaining outstanding
motions relating to discovery.
On November 1, 2005, the parties participated in a telephone status conference with the
hearing officer. Complainant reported that he plans to file a motion for reconsideration of the
Board’s order next week. Respondent will file an amended answer to the complaint by
November 15, 2005. At the next status conference, the parties agreed to present a joint status
report detailing which outstanding motions still need a ruling, and setting forth a proposed
schedule to complete discovery.
The parties are directed to participate in a telephone status conference with the hearing
officer at 10:00 a.m. on December 12, 2005. The status conference shall be initiated by the
complainant.
