Mr. Halloran:
This letter is in response to the affirmative defense written for TNT Logistics North
America Inc.
dated August
18th,
2005.
The defense denied or simply
acknowledged my
original complaints before the Pollution Control Board PCB No.
05-2 17.
Although TNT
Logistics North America Inc. cannot find support for the complaints, a sound study has
been conducted to doewnent noise levels at several sites.
TNT Logistics North America Inc. further states that the trucks causing most ofthe noise
are not owned nor operated by TNT Logistics North America Inc.
It is my contention
that the noise is emanating from their property, and are therefore they are responsible for
its control.
The letter written for TNT Logistics North America Inc. dated August
18th,
2005, phone
conversations with representatives for TNT Logistics North America Inc., and subsequent
letters written for TNT Logistics North America Inc. dated October
14th,
2005 have failed
to adequately satis& my complaints ofnoise pollution.
No actions offered to this date
have caused me to alter or discontinue my original
complaint.
