MOTION TO STRIKE
Now comes Complaint, County ofKankakee, by Edward D. Smith, its State’s
Attorney and
one of his assistants and
moves this honorable Board to strike an
undated letter submitted
and
signed by
a John Hall, Jr.
The Board, by virtue of its
Order dated August 18,
2005, has defaulted South
Holland Trust &
Savings Bank
for failure to
file an answer.
Further, based on receipt of a letter signed
by John
Hall, Jr., the Board has directed that
its Hearing Officer set this matter for a
hearing.
The letter bears the signature of an individual, John Hall, Jr., who is
apparently the son of the named Respondents, John and Ella Hall.
The Halls, as
named in the Complaint, have not filed an answer and the time for filing same has
long since passed.
Accordingly, Complainant moves to strike, as a non-party response to the
Complaint, the correspondence received from John Hall, Jr.
Further, Complainant
respectfully requests that this honorable Board find both John and Ella Hall in
default for failing to
file a timely answer.
