HEARING OFFICER ORDER

On October 13, 2005, all parties participated in a telephonic status conference with the

hearing officer. The petitioner was directed to file its response to the respondent’s motion for

order of protection, filed September 7, 2005, on or before October 20, 2005. The respondent was

granted leave to file a reply. The respondent’s reply, if any, is due to be filed on or before

October 24, 2005. The briefing schedule for the parties anticipated motions for summary

judgment will be discussed at the next status conference.

On September 15, 2005, the respondent filed a motion for leave to supplement the

administrative record and administrative record index and supplement. Petitioner has not filed a

response. Respondent’s motion is granted.

The parties or their legal representatives are directed to participate in a telephonic status

conference with the hearing officer on November 10, 2005, at 11:00 a.m. The telephonic status

conference must be initiated by the petitioner, but each party is nonetheless responsible for its

own appearance. At the status conference, the parties must be prepared to discuss the status of

the above-captioned matter and their readiness for hearing.
