MOTION TO DISMISS
Petitioner,
Carroll
Scientific,
Inc.
(“CSI”),
by
and
through
its
attorneys,
McGuireWoods
LLP,
and
the
Respondent,
Illinois
Environmental
Protection
Agency
(“IEPA”),
pursuant to
Section 40(a)(1) of the Illinois Environmental Protection
Act
(415
ILCS5/40(a)(1)), respectffilly
requests the Illinois
Pollution
Control
Board
(“Board”)
to
dismiss
the above
proceedings.
Per
the continued
discussions
between the
parties,
the
IEPA
issued a revised construction permit on September
14,
2005
and a revised operating
permit on
September
8,
2005.
Based
on the issuance of these permits,
CSI believes there
is
no
basis
to
continue
these
appeals.
The
IEPA
has
no
objection
to
dismissing
these
appeals.
WHEREFORE,
for
the
reasons
stated
in
this
motion,
the
parties
respectfully
request the Board to
dismiss these appeals.
